Welcome to The Monument Store. These Terms of Service ("Terms") govern your use of our website at themonumentstore.com and the services we provide, including monument design, fabrication, delivery, and installation. The Monument Store is a division of Gifford Monument Works, based in Ada, Oklahoma.
By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Services Overview
The Monument Store provides an online platform for designing, ordering, and purchasing custom monuments, headstones, grave markers, memorial benches, and related products. Our services include:
- Online 3D monument design tools (MonuDraw)
- Custom monument fabrication from premium granite
- Cemetery regulation research and approval coordination
- Nationwide delivery and professional installation, including concrete foundation work
- Customer support via phone, email, and live chat
2. Ordering and Pricing
All prices displayed on our website are in U.S. dollars and include the monument, standard engraving, delivery, concrete foundation, and professional installation unless otherwise stated. Prices are subject to change without notice, but we honor the price in effect at the time your order is confirmed.
An order is considered confirmed when you approve the final design proof and submit payment (or an agreed-upon deposit). Design changes requested after order confirmation may result in additional charges and timeline delays. We reserve the right to decline any order at our discretion.
Payment Terms
Payment is required according to the schedule provided at the time of order. Standard payment terms include a deposit at order confirmation with the balance due before installation. We accept major credit cards and other payment methods as listed at checkout. All payments are processed securely through our PCI-compliant payment processor.
3. Design Approval Process
Before fabrication begins, you will receive a digital proof of your monument design for review and approval. It is your responsibility to carefully review all aspects of the proof, including:
- Spelling of all names and words
- Accuracy of all dates
- Correct layout and artwork placement
- Granite color and finish selections
- Monument dimensions
Once you provide written approval of the proof, the design is considered final. We are not responsible for errors in the final product that were present on the approved proof. If we make an error that was not on the approved proof, we will correct it at our expense.
4. Production and Installation Timeline
Typical order completion time is eight to twelve weeks from design approval to installation, depending on granite availability, design complexity, and cemetery approval timelines. We provide estimated timelines but cannot guarantee exact completion dates due to factors outside our control, including:
- Cemetery review and approval delays
- Weather conditions affecting installation
- Granite supply chain variations
- Seasonal demand fluctuations
We will keep you informed of your order status throughout the process and notify you promptly of any significant delays.
5. Cemetery Requirements
Monument installations are subject to the rules and regulations of the individual cemetery. We will research and communicate applicable cemetery requirements as part of our service. However, it is ultimately the customer's responsibility to ensure they have the right to place a monument at the specified location and that all cemetery requirements are met.
If a cemetery denies the monument design or requires modifications after order confirmation, additional charges may apply for design changes. Foundation fees charged directly by the cemetery are the customer's responsibility and are separate from our installation charges.
6. Warranty
We provide a written warranty on all monuments covering defects in material and craftsmanship. Our warranty covers:
- Granite defects including cracking, splitting, or discoloration caused by material flaws (not normal weathering)
- Engraving defects including fading, peeling, or deterioration of sandblasted or laser-etched work under normal conditions
- Installation defects including improper setting or foundation failure under normal soil conditions
The warranty does not cover damage caused by vandalism, natural disasters, acts of God, cemetery maintenance activities, or unauthorized modifications to the monument.
7. Intellectual Property
All content on our website, including text, images, design tools, software, and branding, is the property of The Monument Store and Gifford Monument Works and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
Monument designs created using our tools remain your property. However, we retain the right to use anonymized versions of completed designs in our gallery and marketing materials unless you request otherwise.
8. Limitation of Liability
To the fullest extent permitted by law, The Monument Store's total liability for any claim arising from or related to our services shall not exceed the total amount you paid for the specific monument order in question. We are not liable for indirect, incidental, consequential, or punitive damages, including emotional distress, loss of use, or loss of opportunity.
9. Dispute Resolution
Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes will be resolved through binding arbitration in Pontotoc County, Oklahoma, in accordance with the rules of the American Arbitration Association. Oklahoma state law governs these Terms.
10. Account Responsibilities
If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes become effective when posted on our website. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated via email to registered users.
